STUDIO TERMS & CONDITIONS
1. BOOKINGS & DEPOSIT
Studio sessions are considered confirmed only after the booking has been accepted by Mallywood Studios and the required deposit has been received.
A deposit of €50.00 plus I.V.A. is required for confirmed studio bookings. The deposit will be credited against the final studio invoice.
2. PAYMENT
Unless otherwise agreed in writing, all studio services must be paid in full no later than upon completion of the booked session or before final masters, production files or other deliverables are released.
For larger productions, individual payment schedules and advance payments may be agreed separately.
3. CANCELLATIONS & RESCHEDULING
Studio time is reserved exclusively for the client.
Cancellations or requests to reschedule should be made as early as possible.
For cancellations made less than 48 hours before the scheduled session, the booking deposit may be retained.
In the event of a no-show or cancellation less than 24 hours before the session, Mallywood Studios reserves the right to charge the reserved studio time in full.
4. STUDIO TIME
Booked studio time includes all time required during the session, including setup, recording, listening, editing, breaks requested by the client and other production-related work performed during the booked period.
Additional studio time exceeding the agreed booking period will be charged according to the applicable hourly studio rate.
5. COMPLETE PRODUCTIONS
Prices advertised for complete productions are starting prices.
The final production price depends on the individual project, including composition, songwriting, arrangement, number of recordings, musicians, vocal production, editing, mixing, mastering and any additional services requested.
Third-party costs, session musicians, special licences, additional distribution services, promotional services, video production, travel expenses or other external costs are not included unless expressly stated in the individual offer.
6. MIXING & MASTERING
Mixing and mastering services are based on the material and scope agreed for the respective project.
Substantial changes to the arrangement, new recordings, replacement of tracks or extensive revisions requested after completion of the agreed mix may be charged separately.
7. RELEASE & DISTRIBUTION
Where a production package includes a release, Mallywood Studios may assist with the preparation and delivery of the production for digital distribution.
Release dates and availability on individual streaming or download platforms may depend on third-party distributors and platforms and therefore cannot be absolutely guaranteed by Mallywood Studios.
Separate agreements may apply to label releases, publishing, distribution, artist development and cooperation with Mallywood Entertainment™.
8. COPYRIGHT & THIRD-PARTY RIGHTS
The client confirms that they hold all necessary rights, permissions and licences for any lyrics, compositions, beats, samples, recordings, backing tracks, artwork or other material supplied to Mallywood Studios.
The client is responsible for ensuring that such material does not infringe the copyright, trademark, personality or other rights of third parties.
Mallywood Studios may refuse to use material where the necessary rights cannot reasonably be established.
9. OWNERSHIP & USAGE RIGHTS
Payment for studio time alone does not automatically transfer copyrights, publishing rights, master rights, neighbouring rights or other intellectual property rights.
Ownership and usage rights relating to compositions, lyrics, arrangements, productions, masters and releases are determined by the respective project and, where applicable, by separate written agreements.
10. STUDIO FILES & DATA STORAGE
Clients are responsible for safely storing their final delivered files.
Mallywood Studios may retain project files and recordings for a reasonable period but does not guarantee permanent storage or archiving unless a separate archival service has been agreed.
Clients are strongly advised to maintain their own backups of all delivered material.
11. TECHNICAL INTERRUPTIONS
In the event of a technical failure or other circumstance within the studio's responsibility that prevents a booked session from being completed, Mallywood Studios may offer replacement studio time or another appropriate solution.
Mallywood Studios is not responsible for delays or failures caused by circumstances beyond its reasonable control.
12. PERSONAL PROPERTY
Clients are responsible for their own instruments, equipment and personal belongings brought into the studio.
Mallywood Studios accepts no liability for loss or damage except where liability cannot legally be excluded.
13. CONDUCT IN THE STUDIO
Clients and accompanying persons must treat studio premises, instruments and technical equipment with appropriate care.
The client may be held responsible for damage caused intentionally or through negligent handling by the client or persons accompanying them.
Mallywood Studios reserves the right to terminate a session in cases of serious misconduct, threats, violence, intentional damage or other unacceptable behaviour.
14. RESULTS & COMMERCIAL SUCCESS
Mallywood Studios provides professional creative and technical services but cannot guarantee commercial success, streaming figures, chart positions, bookings, record deals, media coverage or other specific career results.
15. INDIVIDUAL AGREEMENTS
Individual written quotations, production agreements, label agreements, publishing agreements, distribution agreements or artist development agreements may contain additional or differing provisions.
Where applicable, the provisions of the individual written agreement take precedence for the respective project.
